Federal Decree-Law No. 41 of 2022 on the Civil Personal Status is one of the most significant pieces of legislation the UAE has introduced in recent decades. It created an entirely new civil framework for marriage, divorce, and family matters for non-Muslim residents — sitting alongside, and entirely separate from, the UAE Personal Status Law that continues to govern Muslim residents.
Three years into its operation, this law has fundamentally changed the experience of non-Muslim expats going through family legal proceedings in Dubai. Here is everything you need to know about it.
Why Was This Law Introduced?
The UAE is home to one of the world’s most internationally diverse populations. Prior to 2022, all residents — regardless of religion or nationality — were subject to UAE Personal Status Law rooted in Islamic Sharia principles. For many non-Muslim expats, this created outcomes that were unfamiliar and sometimes deeply at odds with their legal and cultural backgrounds.
The 2022 law was introduced to provide a parallel system aligned with international civil law norms — while fully maintaining the integrity of the Islamic personal status system for Muslim residents. It is a sophisticated legislative solution to the challenge of governing one of the world’s most multicultural societies.
Who Does the Law Apply To?
• Non-Muslim expatriates who are legal residents of the UAE
• Both parties in a marriage must be non-Muslim for the civil law to apply to the case
• If one party is Muslim, UAE Personal Status Law applies to the entire case
• The law covers marriage, divorce, child custody, and aspects of inheritance for qualifying residents
• UAE nationals — who are Muslim — are not covered by this law
Marriage Under the 2022 Law
Non-Muslim couples can register civil marriages in the UAE without religious ceremony requirements. This includes couples of different faiths, nationalities, or those with no religious affiliation. Civil marriage certificates issued under this law are valid UAE legal documents — recognised for visa, residency, and other official purposes.
Interfaith marriages — where one partner is Christian and the other Hindu, for example — are no longer the complicated case they once were in the UAE context.
Divorce Under the 2022 Law — Key Differences
• Either spouse can petition for divorce — without needing the other’s consent
• Irretrievable breakdown of the marriage is sufficient grounds — fault does not need to be proved
• No Iddah (waiting period) applies to non-Muslim divorces under this law
• Financial settlements are approached on civil principles — contribution, fairness, and need
• Either party can formally request that the law of their home country be applied to financial matters
Child Custody Under the 2022 Law
• Joint physical custody is explicitly available — a major departure from the traditional Sharia-based framework
• Traditional age-based custody presumptions (mother keeps boys until 11, girls until 13) are not rigidly applied
• Courts use a comprehensive best interests assessment rather than a presumption-based formula
• The mother’s remarriage does not automatically end her custody rights
• Courts consider both parents’ circumstances equally in custody determinations
Inheritance Under the 2022 Law
Non-Muslim expats can register DIFC Wills or civil wills that override the default UAE inheritance rules — which would otherwise apply Islamic succession law (Faraid) to their UAE-based assets. This protection is critically important for expatriates with property, savings, or business interests in the UAE.
How to Access the Civil Law System
The civil law is not automatically applied — you must actively elect to use it. This means engaging a family lawyer experienced with this framework and ensuring the election is made correctly at the outset of proceedings. Our family lawyers have handled civil personal status cases since the law came into force and understand its practical operation in the Dubai courts.
